Agreement to Terms
By accessing or using the services of Graveline Lowell Concrete, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services or website. We reserve the right to modify these terms at any time, and your continued use of our services constitutes acceptance of any changes.
Services Provided
Graveline Lowell Concrete provides professional concrete installation, repair, and related services for residential and commercial clients in Lowell, Massachusetts and surrounding areas. All services are subject to availability, scheduling, and our professional assessment of project feasibility. We reserve the right to decline any project that does not meet our quality standards or safety requirements.
Quotes and Estimates
All quotes and estimates provided are based on information available at the time of assessment. Final pricing may vary if site conditions differ from initial evaluation or if additional work is required. Quotes are valid for 30 days from the date of issue. We will notify you of any price changes before proceeding with work. Payment terms will be specified in your service agreement.
Project Scheduling and Delays
We make every effort to complete projects according to agreed schedules. However, delays may occur due to weather conditions, material availability, permit issues, or unforeseen site conditions. We are not liable for delays beyond our reasonable control. We will communicate any scheduling changes promptly and work to minimize project disruption.
Client Responsibilities
Clients are responsible for providing accurate property information, obtaining necessary permits when required, ensuring site access, and removing obstacles that may interfere with work. Clients must inform us of underground utilities, property boundaries, and any site conditions that may affect the project. Failure to provide accurate information may result in additional costs or project delays.
Warranties and Guarantees
We stand behind our workmanship and provide warranties as specified in individual service agreements. Warranties cover defects in materials and workmanship under normal use conditions. Warranties do not cover damage from improper maintenance, abuse, acts of nature, or modifications by others. Warranty claims must be submitted in writing within the warranty period.
Limitation of Liability
Our liability is limited to the cost of services provided. We are not liable for indirect, incidental, or consequential damages. We maintain appropriate insurance coverage for our operations. Any claims must be submitted in writing within 30 days of project completion. We are not responsible for damage to underground utilities not properly marked or disclosed.
Payment Terms
Payment terms are specified in individual service agreements. We typically require a deposit before beginning work, with the balance due upon completion. We accept various payment methods as specified in your agreement. Late payments may be subject to interest charges. We reserve the right to place liens on properties for unpaid balances.
Cancellation Policy
Cancellations must be submitted in writing. Cancellations made more than 48 hours before scheduled work may receive a full refund of deposits, minus any costs already incurred. Cancellations within 48 hours of scheduled work may forfeit deposits. We reserve the right to cancel projects if site conditions are unsafe or if clients fail to meet their obligations.
Intellectual Property
All content on our website, including text, images, logos, and designs, is the property of Graveline Lowell Concrete and protected by copyright laws. You may not reproduce, distribute, or use our content without written permission. Project photos may be used for marketing purposes unless clients request otherwise in writing.
Dispute Resolution
Any disputes arising from our services will be resolved through good faith negotiation. If negotiation fails, disputes will be subject to binding arbitration in accordance with Massachusetts law. The prevailing party in any dispute may be entitled to recover reasonable attorney fees and costs.
Governing Law
These Terms of Service are governed by the laws of the Commonwealth of Massachusetts. Any legal proceedings must be brought in the appropriate courts of Middlesex County, Massachusetts. If any provision of these terms is found invalid, the remaining provisions remain in full effect.
